Obergefell V. Hodges, 2015: Analysis on Justice Kennedy’s Ruling Decision
The Supreme Court case – Obergefell v. Hodges, 2015 ( Doc. # 65, p.372,)- is the most recent example of the two-century long struggle of Americans to define the meaning of the words “all men are created equal.” Justice Anthony Kennedy’s opinion in the Court’s decision makes a logical and compelling case that the U.S. Constitution (the 14th Amendment) legalizes same sex marriage. This was a 5 to 4 decision, certainly reflecting the deep divisions amongst the public about the contemporary challenges to traditional values. Question: Analyze Kennedy’s arguments pgs. 372 – 376 (a. – c.) and discuss your point of view. Do you agree with the Court’s decision?
